Terms and Conditions for TheCARS - The Complete Automotive Relocation Service
- Definitions
"We," "Us," "Our," and "TheCARS" refer to The Complete Automotive Relocation Service.
"You," "Your," and "Customer" refer to the person or entity using our services.
"Vehicle" refers to any car, van, or other automotive transport subject to our services.
- Acceptance of Terms
By using our services, you agree to these terms and conditions. If you disagree, please do not use our services.
- Service Overview
TheCARS provides vehicle collection and delivery services across the UK. Our trade plate drivers ensure that vehicles are covered for road tax and insurance during transit.
- Booking and Payment
a) All bookings are subject to availability and confirmation.
b) Full payment is required before service commencement.
c) We reserve the right to adjust prices due to unforeseen circumstances.
d) Quotes are valid for 14 days from the date of issue and include fuel and associated charges.
e) Vehicles must be ready for collection on the agreed date. Failure to do so will incur an abort fee equal to 100% of the job's value.
f) Collection and delivery addresses must match those provided at the time of quotation. Any changes may result in additional costs or job cancellation.
- Vehicle Requirements and Condition
a) Vehicles must possess a valid MOT certificate.
b) Vehicles must be in a drivable condition. Non-drivable vehicles will not be collected or delivered.
c) Customers must accurately describe the vehicle's condition before transport.
d) We are not responsible for pre-existing damage not noted before transport.
e) We reserve the right to refuse transport of vehicles in unsafe or illegal condition.
- Insurance and Liability
a) Each vehicle is insured up to £75,000 during the transportation process. This coverage is applicable only when the vehicle is under our direct care and control.
b) Our insurance does not cover personal items left in vehicles.
c) We are not responsible for mechanical or electrical failures during transport.
d) Our liability is limited to the value of our service fee, except where prohibited by law.
- Vehicle Breakdowns During Transport
a) In the event of a vehicle breakdown during transport, the responsibility for recovery and associated costs lies solely with the customer/vehicle owner.
b) The customer must arrange recovery of the vehicle from the location of breakdown to either a safe place or their original delivery address.
c) Once a vehicle breaks down, TheCARS is no longer obligated to complete the delivery as our service is limited to driven collection and delivery using trade plate drivers.
d) An optional premium service is available, which covers recovery costs to the designated delivery location in the event of a breakdown.
- Tyre-Related Damage and Paintwork/Glass Damage
a) TheCARS is not responsible for any damage incurred to the vehicle due to a blown tyre during transport.
b) TheCARS is not responsible for stone chips to paintwork or glass that may occur during transportation. Such damage is considered unavoidable and an acceptable risk of road transportation.
- Electric Vehicles
Electric vehicles must have sufficient range to cover the entire journey. For journeys exceeding the vehicle's range, charging will be arranged and added to the job's cost.
- Cancellation and Refunds
a) Cancellations must be made at least 24 hours prior to the scheduled collection time. Cancellations made with less notice may incur a fee.
b) Refunds are subject to our discretion and may be partial or full depending on circumstances.
c) No-show fees may apply if the vehicle is not available at the agreed time and location.
- Customer Responsibilities
a) Ensure the vehicle is in roadworthy condition with sufficient fuel for loading and unloading.
b) Provide accurate pickup and delivery addresses.
c) Be available at agreed times for pickup and delivery.
d) Remove all personal belongings from the vehicle before transport.
e) Provide a full set of keys for the vehicle.
f) Ensure all necessary documentation is available.
g) Communicate any special instructions clearly at the time of booking.
- Delivery Timeframes
a) While we strive to meet agreed timeframes, delays due to traffic, weather, or other unforeseen circumstances may occur.
b) We are not liable for consequential losses due to delays.
c) Estimated delivery times are not guaranteed unless explicitly stated.
- Subcontracting of Vehicle Transportation
a) TheCARS reserves the right to subcontract vehicle transportation jobs to third-party providers (subcontractors) at our discretion.
b) Subcontracting may be particularly suitable in the following situations:
i. For vehicles that are not roadworthy and require transportation on the back of a truck.
ii. For jobs in remote locations.
iii. For short-distance jobs that are not financially viable for TheCARS to perform directly.
iv. When a subcontractor can carry out the job sooner and at a lesser cost to the client.
c) Any job that will be subcontracted and not carried out by TheCARS will be clearly highlighted to the customer before a quotation is provided.
d) If a job initially quoted to be performed by TheCARS needs to be carried out by a subcontractor, we will notify the customer in advance and cover any difference in the fee.
e) Should the customer not wish to proceed with a subcontracted service after being informed of the change, TheCARS will issue a full refund.
f) When a transportation job is outsourced to a subcontractor, TheCARS will act as an intermediary between the customer and the subcontractor.
g) TheCARS will receive a commission from the agreed transportation price quoted for subcontracted jobs.
h) The subcontractor shall be solely responsible for the execution of the transportation service, including but not limited to:
i. Timely pickup and delivery of the vehicle
ii. Ensuring the safety and security of the vehicle during transport
iii. Compliance with all relevant laws and regulations
i) Liability for any delays, vehicle damage, or other issues arising during subcontracted transportation shall be the sole responsibility of the subcontractor.
j) In the event of any claim or dispute related to a subcontracted job, the customer agrees to pursue resolution directly with the subcontractor. TheCARS will provide necessary information to facilitate this process but shall not be held liable for the subcontractor's actions or omissions.
k) Subcontractors are required to maintain appropriate insurance coverage for the vehicles they transport. TheCARS shall not be responsible for any insurance claims related to subcontracted jobs.
l) TheCARS will endeavor to select reputable and reliable subcontractors; however, we do not guarantee or warrant their services.
m) By accepting a quote for a job that may be subcontracted, you acknowledge and agree to these subcontracting terms.
n) TheCARS reserves the right to cancel or reassign any subcontracted job if the subcontractor fails to meet our standards or your requirements.
o) Any special instructions or requirements for subcontracted jobs must be communicated to TheCARS at booking; we will endeavor to relay this information but cannot guarantee compliance.
p) Payment terms for subcontracted jobs remain consistent with direct services outlined in Section 4.
q) TheCARS shall not be held responsible for any loss, damage, or delay caused by a subcontractor's failure.
r) Once notified that a job originally due from TheCARS will now be carried out by a subcontractor, if you agree, it becomes payable in full even if you later decide against proceeding, provided we've instructed them and made payment; no refund will be issued in such cases.
s) To avoid misunderstanding, we will seek explicit confirmation before instructing a subcontractor for jobs originally quoted by us directly.
t) Customers should carefully consider their decision when agreeing; cancellation after instruction may result in full payment being due without service completion.
u) In cases where we have not yet instructed or paid a subcontractor, our standard cancellation policy applies as outlined in Section 10.
- Privacy and Data Protection
We comply with all relevant data protection laws; see our Privacy Policy for details.
- Force Majeure
We are not liable for failure due to circumstances beyond our reasonable control.
- Amendments
We reserve the right to amend these terms; changes will be posted on our website.
- Entire Agreement
These terms constitute your entire agreement with TheCARS regarding our services.
- Governing Law
These terms are governed by English law; disputes fall under exclusive jurisdiction of English courts.
